1. Definitions

• Member: An individual user who has registered and activated an account at mistpavilion.com.
• Level Points: Points accumulated based on member's consumption and used to upgrade member's level.
• Consumption Points: Points generated based on the member's consumption amount, which can be used for order credit.
• Account Balance: Funds returned to the referrer under the Referral Program that can be used for spending on this site.
• Referrer: A member who registers and spends money through a referral link or code.
• Referrer: A member who invites others to register and spend money.

2. Terms of the Membership Points Program

2.1 Integral system

• This program uses a two-point system:
  • Level Points: According to the member's current level, every dollar spent will earn the corresponding proportion of level points (see the member level table). Level points are used to upgrade the member's level and have no expiration date.
  • Consumption points: According to the member's current level, every dollar spent will get the corresponding proportion of consumption points (see the member's level table for details). Consumption points are valid for 1 year from the date of acquisition and expire automatically.
• Points Issuance: Points are automatically calculated and issued to the member's account within 24 hours after the order is completed and settled.

2.2 Membership levels

Membership levels are divided into the following three categories and upgrades are automatic and permanent (no downgrades due to non-spending):

• Upgrade mechanism: The system automatically upgrades when the accumulation of rank points reaches the threshold. The new grade percentage is applied instantly to subsequent orders, and historical orders are not retroactively adjusted.
• Level Maintenance: Membership level is a permanent status, but members are advised to maintain active consumption to accumulate more consumption points.

2.3 Rules for the use of points

• Credit rules: Every 100 points can be used to offset the value of an order by 1 dollar. There is no minimum threshold for the use of points, you can choose to use them on the checkout page, and the remaining points will continue to accumulate.
• Non-transferable: Points are for your account only and cannot be transferred, exchanged for cash or stacked with other offers (unless otherwise notified by the Site).
• Expiration and Deduction: Spending points expire automatically upon expiration; if the order is refunded, the corresponding points will be deducted (calculated on a pro-rata basis).

2.4 Example of Integral Calculation

• Spend $501 as a Regular Member: Earn 501 Tier Points (automatically upgraded to Silver) and earn 501 Spending Points.
• After upgrading, spend another $100 as a Silver Member: 300 Level Points + 300 Spending Points.

3. Terms of the referral scheme

3.1 Program Overview

• Members can invite their friends (referrals) to register and spend, and receive 3% of the amount spent by the referrals as a rebate on their account balance.
• Cashback is only applicable to purchase orders from referrals registered through the referral link or code.
• The account balance is not withdrawable and can only be used for the consumption of orders on this website.

3.2 Modalities of participation

• Generate Invitation: Members can log in to the "Referral Management" page in the Personal Center to generate exclusive referral links or invitations with one click.
• Share & Register: Referrals register for an account via link/code and complete their first purchase (no threshold for minimum purchase amount).
• Cashback issuance: Cashback will be automatically credited to the referrer's account balance within 24 hours after the referrer's order is completed.

3.3 Calculation and Use of Cashback

• Calculation rule: Cashback = Referrer's purchase amount × 3% (rounded up to two decimal dollars).
  • Example: Referred person spends $100, referrer receives a $3 account balance.
• Usage rules: Account balance is automatically accumulated and can be used to offset the order amount at checkout, with no minimum usage threshold. The balance is valid for 1 year from the date of acquisition and expires automatically.
• Restrictions: Each referee is limited to providing cashback to one referrer only; the same referral link cannot be used repeatedly for the same user; cashback does not apply to refunded orders (the actual cashback amount of the refunded order is deducted).

3.4 Prohibited acts

• It is prohibited to use fake accounts, swipe orders or other fraudulent methods to participate in the referral program. Once found, the website has the right to freeze the account, deduct the cashback and cancel the membership.

4. General provisions

4.1 Eligibility requirements

• Members must be at least 18 years old and have full capacity for civil behavior.
• This program is available only to legitimate users of this website and does not apply to employees, agents or their immediate family members (unless otherwise notified).

4.2 Privacy and data

• The Site will collect necessary data (e.g., consumption history, referral link usage) for program implementation and in compliance with the Privacy Policy. Members consent to such data processing.

4.3 Modification and termination

• This website reserves the right to modify, suspend or terminate this program at any time. Members will be notified of major modifications 7 days in advance via website announcement or email.
• If a member violates the terms and conditions, the Site reserves the right to terminate his/her participation immediately and deduct all unsettled points/balance.

4.4 Disclaimer

• This program does not constitute any financial guarantee. The value of points/cashback is subject to market fluctuations and this website is not responsible for any consequential losses.
• These Terms shall be governed by the laws of Hong Kong and disputes shall be resolved by arbitration.
